Holocaust Denial in Today’s Courtrooms and What It Means for Justice and Memory

A few years ago Linda Kinstler discovered that a man fifty years dead – a former Nazi who belonged to the same killing unit as her grandfather – was the subject of an ongoing criminal investigation in Latvia. The proceedings threatened to pardon his crimes. They put on the line hard-won facts about the Holocaust at the precise moment that the last living survivors – the last legal witnesses – were dying.

Around the world, Second World War-era cases are winding their way through the courts. Survivors have been telling their stories for the better part of a century, and still judges ask for proof. Where do these stories end? What responsibilities attend their transmission, so many generations on? How many ghosts need to be put on trial for us to consider the crime scene of history closed?

The Ben & Jerry’s Saga

Last year Ben & Jerry’s, a subsidiary of Unilever, decided its ice cream should no longer be sold in the “Occupied Palestinian Territories” (East Jerusalem, Judea and Samaria), claiming this to be “inconsistent with our values”, and to terminate its longstanding Israeli licensee who could not accept this policy.  Following this decision, Unilever’s share price fell sharply, several US states divested, leading investors criticised Unilever’s Board, and legal actions ensued.

For almost a year Unilever claimed that it could not override the decision of its subsidiary’s independent Board, but then recently did just that: as part of a settlement of a case brought by Ben & Jerry’s Israel licensee, Unilever sold the Ben & Jerry’s brand in Israel to the licensee, enabling the licensee to continue distributing the ice cream in Israel and its territories. The latest twist is that Ben & Jerry’s board has now sought to block the sale in court, claiming that its parent Unilever is breaching the merger agreement between the two companies.

Professor Fried will discuss the various legal claims and issues, what may happen next, and the implications for BDS.

The Trojan “Bourse”

Dan Harris, a leading specialist in the financial markets, will be talking about his new book, “The Trojan Bourse” which  analyses how the Boycott Divestment and Sanctions (BDS) movement seeks to influence divestment and exclusion of stocks from investment portfolios.

Harris likens this to the Greek myth of the Trojan Horse – where the Greeks besieging Troy built a wooden horse, hid soldiers inside it, and left it outside the city, as a gift.  When it was wheeled into Troy, the Greek soldiers jumped out and sacked the city.  In Harris’s analogy, the securities markets are encircled by a wall of laws and financial regulations. The votive gift is information, but the information conceals within it a political agenda, that will wreak havoc if brought inside the citadel.
